The 4th Circuit Federal Court will "look through" or ignore attorneys attempts to characterize marital property distributions as non-dischargeable support. This can include an obligation to pay retirement benefits, including government thrift savings, pension plans, IRAs, and 401Ks, so long as no Qualified Domestic Relations Order has been entered giving the payee spouse a present interest. Dunlap & Grubb has successfully litigated this issue in state courts, Federal Bankruptcy Court and on appeal in Federal District Court.
